Court Approves Substituted Service for Senator Natasha Akpoti-Uduaghan’s Case Against Akpabio, Nwaebonyi

Abuja:  An Abuja High Court has granted suspended Senator Natasha Akpoti-Uduaghan permission to serve court documents via substituted means on Senate President Godswill Akpabio and his aide, Mfon Patrick, as part of her legal challenge over her suspension.

Justice Abubakar Idris Kutigi issued the ruling following an ex parte application filed by U.J. Udoh, counsel to Akpoti-Uduaghan.

The court allowed service of the documents, including Motion No: M/6603/2025, through the Office of the Clerk of the National Assembly, instead of direct personal delivery.

The court’s initial directive on May 15, 2025, permitted all legal documents related to the case to be delivered to the Clerk’s office. The matter has been adjourned to June 9, 2025, for an update on the service status.

In a separate but related ruling, Justice A.O. Otaluka of another Abuja High Court granted similar permission to serve Senator Onyekachi Nwaebonyi through substituted service.

Justice Otaluka approved that the Writ of Summons and related documents could be delivered by publishing the notice in a widely circulated national newspaper and submitting a copy to the National Assembly Clerk’s office.

This order was granted under Order 9, Rule 4 of the 2025 Civil Procedure Rules of the High Court of the Federal Capital Territory (FCT), Abuja.

The court set June 25, 2025, for the hearing of the substantive suit, registered as SUIT NO: FCT/HC/CV/1359/25.
