ABUJA: A Federal High Court in Abuja has struck out the eight-count criminal charge filed by the Federal Government against Adeniyi Adeyemi, who is accused of falsely presenting himself as the Director-General of the Presidential Foreign Intervention Promotion Council (PFIPC).
Justice Mohammed Garba Umar struck out the case on Monday, October 12, 2026, following an application by the Federal Government to terminate the existing proceedings and transfer the matter to the High Court of the Federal Capital Territory (FCT) for a fresh arraignment.
The decision followed a review of the case file and the original charge, which the government said contained legal issues requiring the matter to be prosecuted before a different court.
However, the striking out of the charge does not amount to an acquittal on the allegations against Adeyemi, as the government said it had already filed a fresh charge before the FCT High Court.
At Monday’s proceedings, the Director of Public Prosecutions of the Federation, Rotimi Oyedepo, SAN, presented the application seeking the termination of the case.
Oyedepo told the court that the Attorney-General of the Federation and Minister of Justice had reviewed the case file and the charge initially filed by the Inspector-General of Police.
According to the prosecution, the review identified legal loopholes in the original proceedings, prompting the decision to pursue the allegations before the FCT High Court.
The Director of Public Prosecutions explained that the documents allegedly forged by Adeyemi in connection with the purported agency involved offences that could be prosecuted by the FCT High Court rather than the Federal High Court.
He further informed the court that a fresh charge had been filed before the FCT High Court and that Adeyemi would be arraigned again without delay.
The prosecution consequently asked Justice Umar to strike out the existing charge in accordance with the law.
Adeyemi’s counsel, Ibrahim Angulu, SAN, did not oppose the Federal Government’s application.
Following the absence of opposition, Justice Umar granted the request and struck out the eight-count charge before the Federal High Court.
The case was registered as FHC/ABJ/CR/25/2025 and involved Adeyemi and two other defendants who were said to be at large.
The charges bordered on conspiracy and forgery, although the allegations have yet to be determined through a final judgment in the proceedings described in the report.
The prosecution’s decision to initiate fresh proceedings means that the allegations against Adeyemi are expected to be considered by the FCT High Court.
Adeyemi, 38, was charged alongside two other individuals identified as Femi, whose surname was not provided, and Anu, also identified without a surname.
Both individuals were reported to be at large as the case proceeded before the Federal High Court.
The available court report did not provide further details about their whereabouts or whether they had been included in the fresh charge filed before the FCT High Court.
It also did not disclose a date for Adeyemi’s proposed fresh arraignment.
The next major development will be Adeyemi’s expected arraignment before the FCT High Court, where the Federal Government intends to pursue the allegations under the newly filed charge.
The prosecution’s decision to withdraw the original charge followed its review of the legal basis for bringing the case before the Federal High Court.
The fresh proceedings will provide the next opportunity for the allegations to be formally presented before the court with jurisdiction to hear the matter, as stated by the prosecution.
For now, the Federal High Court’s decision ends the existing proceedings before it but does not resolve the underlying allegations of conspiracy and forgery.
Adeyemi remains entitled to the presumption of innocence unless and until the allegations against him are proved in court.
RapidoSpace News will continue to follow the case as further details emerge about the fresh arraignment and the progress of the proceedings before the FCT High Court.
