He declared, “The party restraining the Rivers State Chief Judge and the Clerk of the Rivers State House of Assembly from receiving or acting upon any resolutions from certain individuals until the outcome of a case before it is decided.”
According to Mr. Ologunagba, the PDP national legal adviser is the only person authorized to handle the party’s litigation, prosecution, and defense of cases.
As specifically stated in Section 42 of the PDP’s Constitution (as revised in 2017), he continued, “On behalf of the party’s organs, chapters, and officials, only the national legal adviser also had the exclusive power to do that.”
“On January 17, 2023, our party released a public notice informing the public that the national legal adviser is the only authority, office, or organization with the right to bring litigation or hire outside attorneys to represent the party in court.
The engagement must also be in writing, signed by the national legal adviser, and include a description of the case’s specifications
He continued by saying that, as specifically stated in Section 42 of the PDP’s Constitution (as modified in 2017), only the national legal adviser had the unique authority to act in that capacity on behalf of the party’s organs, chapters, and officials.
“Therefore, the PDP dissociates itself,” he stated.
